Terms of Use

Thank you for participating in the Save NB Surf Park mobile messaging program (the “Program”). By opting into the Program, you agree to these Terms of Use (the “Terms”). If you do not agree with these Terms or no longer wish to participate, you can reply “STOP” to any text message you receive from us to opt out of the Program.

Consent to Receive Messages

By subscribing to the Program—whether through a form on the Save NB Surf Park website, at an in-person event, or by texting a keyword like “JOIN”—you are giving your express consent to receive automated text messages, alerts and updates at the mobile number you provide. Participation in the Program means you accept and agree to these Terms. Your consent to receive messages is not a condition of any purchase.

Message Delivery & Reliability

We are not responsible for any delays or failures in receiving SMS messages, since delivery depends on your mobile service provider. The SMS service is provided “as is,” without any implied or expressed warranties of merchantability or fitness for a particular purpose. Mobile carriers and service providers are not liable for delayed or undelivered messages.

Data Collection & Use

When you enroll in the Program, we may collect and use the following information:

  • Your mobile phone number

  • Your carrier’s name

  • The date, time and content of messages exchanged

  • Any other information you provide to us

We may use this information to send you messages and deliver the services you request. If your mobile number changes, is deactivated or otherwise becomes unusable, you agree to notify us promptly. Failure to do so may be considered a breach of these Terms.

Program Changes

By enrolling and using the Program, you acknowledge and agree that Save NB Surf Park reserves the right to modify or terminate the Program at any time, with or without prior notice.

Opt-Out & Help

To cancel your SMS subscription, simply reply “STOP” to any message you receive from us. You will receive a confirmation that you’ve been opted out.

Supported Carriers & Message Rates

The Program supports major U.S. mobile carriers (including Verizon, AT&T, T-Mobile, Sprint, Metro, Boost, Virgin Mobile USA, U.S. Cellular and others). Message and data rates may apply through your carrier.

Eligibility & Program Availability

By subscribing, you represent that you are at least 13 years old and that you are either the subscriber to the wireless account or have the account holder’s permission to receive text messages under these Terms. The Program is only available to residents of the United States. You may not sign up for or use the Program from outside the U.S. You also agree to comply with U.S. export control and other applicable laws when using the service.
